The Costa Brava is a coastal region of northeastern Catalonia, Spain, in the comarques of Alt Empordà, Baix Empordà and La Selva, in the province of Girona. Costa is the Catalan and Spanish word for ‘coast’, and Brava means ‘rugged’ or ‘wild’. The Costa Brava stretches from Blanes, 60km northeast of Barcelona, to the French border.

In the 1950s the Costa Brava was identified by Spain’s Franco government as being suitable for substantial development as a holiday destination, mainly for package holiday tourists from Northern Europe and especially the United Kingdom. The combination of a very good summer climate and excellent beaches was exploited by the construction of large numbers of hotels and apartments in such seaside resorts as Blanes, Tossa de Mar, Lloret de Mar and l’Estartit. Tourism rapidly took over from fishing as the principal business of the area.

Whilst part of the Costa Brava coastline leant itself to tourist developments on a very large scale other parts have retained a more traditional look and have become "hidden gems" for visitors who want a little more than sun, sand and sangria. Small towns like Cadaqués (close to the French border and close to the foothills of the Pyrenees) have attracted artists such as Salvador Dalí and Pablo Picasso and are now fashionable resorts. The coast between Roses and Tossa de Mar has many delightful small coastal towns such as Pals, Begur, Tamariu, Llafranc, Aigua Blava, Fornells , Calella de Palafrugell and Sant Feliu de Guixols.

In 1998 coastal towns of the Costa Brava signed a charter the Carta de Tossa which undertook to pursue environmental protection along with tourism. This recognised the value of the region’s wide range of natural habitats and micro-climates. The Islas Medes off the coast of L’Estartit is Spain’s first maritime nature reserve and it provides a home to a wide range of fish and acquatic flora. The nearby wildfowl reserve on marshlands at l’Emporda also saved land from the potential ravages of development.

The recent demise of the XL Group, a major UK travel company with its own airline and trading under established brands such as Kosmar and Medlife Hotels is an unnerving event for all holidaymakers. With over 20 airlines ceased trading in the past year, how can we be sure that we will not be placed in a similar situation of loss when we book with any travel company or airline?

It is interesting that the statement on the XL group’s website said: “The companies entered into administration having suffered as a result of volatile fuel prices, the economic downturn, and were unable to obtain further funding.” In a comment from rival holiday firm TUI, it is clear that the industry mandarins are warning that due to rising fuel prices, and less money available from banks due to lending restrictions brought on by the credit crunch “airlines with less than robust business models” – such as XL – were now failing. Clearly the mandarins of the bigger holiday companies are clear that their business models are indeed robust, and we should believe them of course.

But clearly, company size is not everything – XL was actually the 3rd largest operator in the UK – and so it is important always to understand what financial protection is available in the event that the worst happens and your holiday company fails.

In the UK, the Civil Aviation Authority oversees the ATOL licensing system whereby any operator or airline offering holidays by air pays into a bonding scheme based on its business turnover. Funds thus generated are used to repatriate holidaymakers, or refund money paid in advance for such bonded holidays. It seems even more important in these difficult times, to make sure that you ensure every element of your holiday is ATOL protected.

However, it is important to know that this scheme is no a “catch-all”, when a holidaymaker has booked a “flight only” or a flight and accommodation separately. In the XL demise, it is estimated that more than 10,000 people were not ATOL protected because they booked separate flights and accommodation or flights only. In these days of do-it-yourself holiday packaging via separate bookings via the internet, this situation is unlikely to improve unless legislation changes.

Many consumer rights groups are vociferous in their demands that the Government should take steps to ensure all holiday companies must belong to the ATOL scheme, which offers package holiday makers financial protection. However, it is difficult to see how a scheme run via the Civil Aviation Authority should be able to cover elements of a holiday such as hotels which are purchased separately and are not in an “Aviation” remit.

Because such “Do-It-Yourself” holidays aren’t protected by the ATOL scheme, it is important to think about alternative protection. Examples are:

Book with a credit card: But be careful here, because you still might not be covered. You must spend at least £100 on each element of the holiday – and charge cards or debit cards do not offer any protection.

Take out travel insurance: Look for policies which cover against holiday company or holiday provider insolvency. However, it is vital to check the small print, as many policies don’t include this cover.

And also remember the important fact that you can only be covered for the component of your holiday that’s gone out of business. You can’t claim for the others and so you will need to rebook the missing element – possible at a higher price, or possibly with difficulty of any availability at all.

Sometimes, it seems much easier to book a complete package supplied by a single ATOL bonded operator – but taking these few small steps will at least ensure you have the same financial protection outside the scheme, even if you are more “on your own” in the event of a business failure.

A package holiday is, by definition, a pre-arranged holiday comprising of at least two components booked together, such as the flight to the destination and the accommodation itself. While package holidays can sometimes be more expensive than booking each part individually yourself, there are more safeguards in place should anything go wrong.

The law states that a package holiday which is offered by a tour operator must be of a reasonable standard, and match the description given in the brochure. For example; if the brochure states that the hotel has a sea-view from each room, then this must be so. If the hotel is classified as a luxury hotel, then it must not be of a basic budget standard. If the hotel is a budget hotel, common standards of hygiene must still apply – sharing a suite with half the local insect population and 3 varieties of fungi are not classed as common standards of hygiene.

Once you have booked your holiday with the tour operator, you have entered into a legally binding contract and both parties must adhere to certain terms and conditions. The travel agent must make you fully aware of the booking conditions, usually printed in the brochure, and provide you with any information you may require which relates to your holiday. This includes notifying you if there are any dissimilarities between the brochure description and the current state of the resort i.e. if the hotel is having building work done or the swimming pool is closed for some reason. If this is the case, you are entitled to an alternative holiday of comparative value, or a refund.

There is often confusion about the price of a package holiday; the price advertised doesn’t always include all the non-essential yet rather important extras such as airport transfers, in-flight meals, and even the privilege of being able to sit with your family on the plane. The ‘from’ price is more often than not the price for the absolute basic flight and bed package – made glaringly obvious to lure the unsuspecting tourist into a holiday which, in reality, could work out much more expensive.

Fortunately, once you’ve sorted out exactly what you’re paying for and have handed over the money, you should be protected if the price was to rise significantly. This means that if you book your holiday a while in advance, and the price rises in the meantime, your travel agent cannot charge you extra to cover this, unless it specifically says this is allowed in the booking conditions. Even then, if the increase is due to anything other than rising fuel costs, landing fees or the exchange rate, you cannot be charged. The first 2% must also be absorbed by the agent and anything over 10% increase will automatically entitle you to a refund without a cancellation penalty, or a replacement holiday at the original price.

Be aware that some tour operators try to push travel insurance on you at the time of booking, and may make you think this is compulsory. It isn’t. While travel insurance is always highly recommended, you can usually get a better deal looking for it yourself, as agents tend to charge a fee on top of the premiums, meaning you could be paying much more than necessary.

Although you may be tempted to avoid package holidays altogether and book everything yourself, should something go wrong with your holidays you have more of a financial safety net if you book a full package. Finding cheap holidays with an ABTA registered travel company is easy if you browse online.
